His plan was to make sure that the guns are in the hands of reliable people and if they were not reliable, then the guns would be confiscated from them. The Second Amendment stated, “The right of the people to keep and bear arms” (Second Amendment). By this Amendment it meant that the people living in America were allowed, by the Constitution, to have the freedom of owning a gun and buying at their own risk. They were also allowed to carry guns and buy them, by choice, and therefore, Obama’s executive action limited gun purchase on specific people, whom could not be trusted. His executive powers did not allow him to perform this action of background checks on health and gun purchases without the consent of Congress. Yet, he was fully determined to pass this law and he admitted to keeping the Second Amendment in mind, but he thought that the Amendment was not capable of some Americans to handle. He believed that there was a need for having “constraints on freedom”(GOP Congresswoman), but obviously his executive powers did not back up his suggestions on constraining. Another view on the gun control is that Obama did have enough examples of mass shootings, in Sandy Hook and Chicago, which made it totally acceptable too, that guns should only be purchased by sane people and those who are legally fit. By Article 2 of the Constitution, it stated that the president was allowed to propose his own laws, but needed Congress’s consent to pass them. Obama's gun control law was not accepted by a majority of the members. One of the members said, “For a president who bragged in his speech about having taught constitutional law, he ought to at least understand that Congress makes the laws, not the president — that’s elementary civics” (GOP Congresswoman). Congresswoman, Diane Black, was outraged by the speech of Obama about forcing more gun control. She degraded him as she said that he taught constitutional law, yet never understood that he could not make the laws without Congress’s consent. By the Constitution, she was correct. Executive actions needed to be accepted by Congress before they were enforced. Black, as a congresswoman, felt low of her standards. She could not believe that the President had acted in an unconstitutional way and was sealing the political legacy, by taking her congressional powers. Obama said Congress, which blocked a tougher gun bill in 2013, still needs to impose new gun control measures. He noted that many of the actions he's calling for can only be imposed through legislative action (Obama Executive Action).
