On a wonderful morning of 16th of may 2015, Mrs. Harjeet Kaur (60 years) (fictitious) left her home to take a bus from her nearby Bus stop and wait there till the bus arrived along with some other passengers. Mr. Jack (fictitious) was driving the bus, he was a little late from time so seemed to be in hurry. When he saw Mrs. Harjeet Kaur and her fellow passengers standing on the bus stop, he stopped the bus for them. Because the driver was in hurry, he did not see harjeet kaur, who was still tried to get into the bus. When she put her first step in the bus, suddenly driver moved the bus and she fell down on the ground. According to the complaint which Mrs. Kaur filed to the Police she was “seriously” injured, broke her leg and hip which needs an expensive surgery to heal.
So, she sued the driver of the bus, Mr. Param to act negligently while performing his duty as a driver and filed a statement of claim against him, for general damages including Hospital costs, emotional turmoil and court costs over and above exemplary damages for his negligent act.

Jack was the Driver of a Government funded and regulated service and he was hired after many tests, moreover, as a public transport driver he was given a special training to drive a bus, dropping and taking passengers, more specifically he was provided with knowledge of every function of bus and Government spent money to train him. That was why he had special duties to the society and he held higher standard of care to his passengers and society. A highly trained driver is not expected to do such a careless thing.
