Negligence In Law

Negligence, in law, is defined as the failure to use reasonable care, resulting in damage or injury to another. Every year in the United States, an average of 38 children die in the back of cars from hyperthermia. This negligence is considered involuntary manslaughter by the law, and deserves jail time. With a good enough lawyer, some of these guardians get supervised probation, and avoid jail time. Negligent guardians who leave the children they are responsible for in hot cars should be jailed because of the responsibility undertaken when caring for a child and the example it will set for future guardians to be more aware of their young ones. The child’s grandmother says “I'm mad, but at the same time, accidents do happen. I'm sure he is beat down inside.”(Connor). Evidence suggests that Jackson had no intention of killing his child, yet he still had a responsibility to watch over and care for him. His lawyer adds, "He knows he made a mistake and he accepts responsibility for the mistake.” (Connor). Jackson’s imprisonment will show others that his mistake is not one that others need to make. The media attention that Seth is getting is good because it is helping to show the punishment that people like him need to receive. With people viewing Jackson on the news, awareness spreads and guardians will know to pay more attention to their child. Rebecca Robbins researched technologies that could be used. In 2001, General Motors created a radar sensor that “would be able to detect the breathing of a sleeping baby strapped into a car seat, and then sound an alarm to alert passersby if the car got too hot.” (Robbins). The idea was scrapped because of lack of support, but “A father from tennessee launched an app called Remember the Kids which uses an algorithm to track a driver’s movements. The app sends an alert asking “Did you Remember the Kids?” whenever a parent stops moving for several minutes.” (Robbins). Also, a father from alabama developed a device called Starfish, “a weight-activated car seat sensor that sends parents a smartphone alert if they stray too far from their car.” Large companies, inventors, and independent app creators are all doing their part to develop technologies that can prevent hot-car deaths. The technology just needs to be applied to today’s cars. Application will be more effective if it is enforced by the government. Laws should be put into effect that requires car companies to apply technology that helps to prevent hot-car deaths in their vehicles. This way there will be no excusing hot-car deaths for anyone that has these preventative measures in their cars, and there will be less deaths
