Given the information presented, Franklin violated the workplace policy stating “that an employee reporting to work late, more than once in a sixty-day period will be dismissed” which resulted in his dismissal. Although China Lights can argue that the violations of the policy (reporting late to work twice, 55 days apart) is what prompted Franklin’s dismissal, Franklin’s experience of his coworkers (Jin Pan and Dongping Jiang are late practically every day with no action taken against them) could provide basis for a claim with the Equal Employment Opportunity Commission claiming National Origin Discrimination.
