In the chief prosecutor vs Motiur Rahman Nizami the tribunal found that Motiur Rahman Nizami was the president of ICS exercised his prominent position in transforming Islami Chhatra Sangha into Al-Badr Bahini to know the consequences of his actions that he basically encouraged, Members of Al-Bahr Bahini to commit crimes against humanity, including genocidal killings of intellectuals all over Bangladesh. The accused have superior power, a position and a real influence on Al-Badr is a proper indication of support that has had a causal relationship with members of Al-Badr and its subordinates who have effective control over them. Therefore, it is not possible to alleviate responsibility for the alleged crimes committed by members of Al-Badr Bahini with whom he had de-facto superior-subordinate relationship. It is clear that during the war of liberation, the defendant gave a lot of provocative speeches to ICS members who eventually became members of Al-Badr Bahini and committed crimes against humanity at random.
The accused as chief of Al-Badr Bahini exercised his superior status but he never tried to prevent his subordinates from committing atrocities.
