Freedom of race discrimination regarding employment is overseen by both state and federal statutes, but businesses that discriminate in their dealings with other businesses are not ruled under federal law, and state laws may be unsuccessful. No federal statute ever has been implemented specifically to prohibition racial discrimination in private commercial dealings between two business firms. (The Civil Rights Act of 1964 and the Equal Employment Opportunity Commission. (n.d.) While both federal and state laws protect employment rights and there have been some improvements, there is no equivalent protection for minority owned businesses that come across some form of discrimination. While business discrimination happens in both the private and the public division, Rather than relying on general bans of discrimination, governments have created programs intended to assist minority businesses. …show more content…
President Nixon established the Office of Minority Business Enterprises in 1969 as part of his efforts to lead minority entrepreneurship. The agency's purpose was to provide management and technical assistance, information, and advocacy in the private sector for minority business development. (Minority Owned Businesses Law & Legal Definition. (n.d.)
The Small Business Administration (SBA) also increased efforts to help minority business owners get necessary financing. The agency introduced two programs; loan assistance and special procurement of federal contracts, known as set-asides. Many state and local governments set up similar privileged contracts to assist minority contractors (Cox, J. (n.d.). Set asides were first produced, when the U.S. government passed a law that set aside five percent of all procurement contracts for small businesses that are owned by socially and economically underprivileged individuals.
