Midland Police Vehicles: A Case Study

On Thursday, May 27th, 2016 at approximately 2000 hrs while driving a Midland Police vehicle and wearing a standard issued MPD uniform Officer Jimenez was traveling south in the 900 block of South Lamesa. Officer Jimenez then observed a white Ford F150 (TXLP-DHL8246) traveling southbound in the same location. Officer Jimenez then observed the vehicle had an expired registration.

Officer Jimenez turned the emergency lights of the patrol vehicle in order to conduct a traffic stop. Upon turning his lights on the vehicle went westbound in the 900 block of East Florida and came to a complete stop. Officer Jimenez then contacted the driver who was identified as Armando Perez (H/M-DOB07/19/1974). Officer Jimenez explained the reason for the stop and asked Perez for a driver license and proof of insurance. Perez was also unable to produce a driver license. Perez provided

Officer Jimenez then observed that Delao had the two opened beer cans on the floor near him. Officer Jimenez asked Delao to step out of the vehicle, which he complied. While talking to Delao Officer Jimenez could smell a strong odor of alcoholic beverages coming out of his breath. Delao seemed extremely disoriented.

Officer Jimenez asked Perez to step out of his vehicle. Perez had strong odor of alcoholic beverages coming out of his breath as well. Perez advised Officer Jimenez that one of the beers was his and the other one was Delao. Officer Jimenez conducted the Horizontal Gaze Nystagmus on Perez and determined he was not intoxicated. Perez told Officer Jimenez he just got off work and just bough those two beers for him and Delao.

Officer Jimenez observed that both Natural Light Beer cans were open and still had some of its alcohol content inside. Officer Jimenez observed that the beer cans were in arms reach of Perez and Delao therefore they were in care, custody, control and management of
