Officer Nighthorse acted in this case just as any officer should have. When he received the call to the Qwiki Mart, he rushed over and received descriptions of the burglar from both the victim and the clerk. After finding Jesse Caufield, a teen who matched the description of the robber, he also discovered the victim’s wallet and a wet Blazers hat in Jesse’s possession. These two pieces of evidence further suggested Jesse Caufield as the thief. The officer did his job by handcuffing the teen.…
Randy Furst’s article “Black defendants, white jurors: Does race make a difference in the court?” is about racism and reveals that an all white jury is more likely to demonstrate racial prejudices against a defendant of color as demonstrated by his use of evidence. Specifically, Furst’s use of evidence suggests that on a mixed jury, jurors will acquit a non-white defendant more times than an only white jury. The first insight into the racism that non-white defendants have to face occurs when Larry Leventhal, Twin Cities defense attorney, says “‘I think it would be a challenge to get a jury that considers all the factors when the jury is white,’”(1). Leventhal’s reference to juries considering factors while white demonstrates that if a jury…
Here is how misidentification often occurs: A crime is committed, the victim claims they have a vivid memory of the perpetrator, a composite sketch is created and the victim chooses a suspect from the photo and physical lineup. The investigators think they have caught the perpetrator and done justice. They are often times wrong. Eyewitness misidentification has been known as the leading cause of wrongful conviction. A study by the Innocence projects depicts that it plays a role in 72% of wrongful convictions.…
The only reason Hines was let off easy was because he was an accomplice to the ambiguous white mans crime, and Murton being of a lower class meant her justice was not as important. Secondly, is the prosecution of the Freeman family. This is a different narrative than other sentencings of African people, as the Freeman family were recognized as respectable, owning a successful agricultural…
"These are the flowers we bought this morning, the dahlias tossed on his grave and bells waiting with their tongues cut out for this particular silence. " I believe his quote falls under second degree. To me, First degree would be top notch, the best of the best. Second is good, and their is bad. This small piece of literature is different from any other piece I've seen, that is why I chose it.…
Historically African Americans have received the downside to civil matters causing social upheaval. African American individuals have been racially discriminated due to the color of their skin and not their humanistic output towards a situation. Stereotypes and recent progression on perception have forced people to assume that everyday rights have been granted to all individuals no matter their racial background. Due to this aspect, African Americans are placed into a cast system with a harsh system of operations. “The New Jim Crow” by Michelle Alexander and “The Jail” by John Irwin…
Early research on the role of race and ethnicity in criminal sentencing was more descriptive than theoretical. The methodologies involved in early studies were weak, and when theoretical explanations were offered, they often entailed unsophisticated notions of individual prejudice and racial discrimination. For example, Thorsten Sellin (1935) conducted simple comparisons of the average length of sentences given to black, native-born and foreign-born white male prisoners within very broad offense categories. Sellin claimed that the data revealed "the marked influence of race and nationality prejudice in the administration of justice" (p. 212). He concluded that, in light of the prejudice against blacks and foreign born within the society at large, "it would be denying to the judge the ordinary attributes of human nature to assume that he could render justice free from all preconceptions"…
Stereotypes are, of course, not without any truth. The fact that there is a stereotype confirms its derivation of a common practice or characteristic of an individual or a part of a group. Acting on judgement based on stereotypes, however, is simply illogical and foolish. This especially applies to the practices of law enforcement. Although seemingly separate entities, the police force of a community and the general public it serves and protects are intertwined; each must be able to interact with no fear of repercussions on either party.…
One of the other significant issues facing the African-American, and our community as a whole, and is brought up in the New Jim Crow is: the myth of color-blindness of our Criminal Justice system. Michelle Alexander reiterates, that despite the popular belief, our Criminal Justice system is not color-blind after all. She proves this argument by illustrating case after cases where our criminal justice system has treated exactly the same scenarios differently. The only noticeable difference in such similar situations has been the color and race of the defendants.…
The rate of African Americans shot or killed by police far exceeds the rate for Whites. However, as noted, there remains debate as to why this is the case. Several researchers subscribe to the belief that police discretion, or “differential policing,” largely explains the disproportionality. Others hold that racial imbalance is a reflection of the struggles associated with being a member of a disadvantaged class, including social inequality and economic deprivation(Baker, 2015, p.242).…
Police Brutality and Racial Disparities Introduction Police brutality against African Americans is a widely discussed topic across the states. However, what cause the police to be so? Why do they use excessive and deadly force against them? And is it really only about African Americans or does the other ethnicities encounter the same problem?…
Prejudice is a hostile or negative attitude toward people in a separate group, due to their membership in that group (Aronson, Wilson & Akert, 2013). It has been with humanity since a long time ago, but it is only recently, within the 20th and 21st centuries that prejudice has surfaced more than ever, especially regarding the stereotypes of gender, to serve the rights of humans. Even recently, there have been news that were published in regards to prejudice and discrimination. The first news article concerns the shooting of 12-year-old Tamir Rice, in the United States, by another police officer because Rice ‘failed to obey an order to raise his hands’ after being caught pulling out a replica gun, which lacked of an orange safety indicator,…
In Modern day America racial profiling has become a major issue. According to Higgins (2008), profiling is a conglomeration of physical, behavioral, and psychological components that increase the probability of apprehending a suspect. During the 1980s, law enforcement began introducing race as a trait for profiling an individual. This was during the rise of drug use in the United States. Racial profiling allowed law enforcement officials to identify drug couriers.…
Memory is the name given to the process of storing and retrieving information. We would be unable to learn without it. Memory helps to process different variations of information, such as pictures or sounds. It allows us to recall what has happened in our past, and lets us make predictions about future events and consequences of actions. Memory is an individual behaviour by which we retain information about events that have happened in the past.…
Philosopher, Jiddu Krishnamurti once said, “The ability to observe without evaluating is the highest form of intelligence.” (Vajda, 2009). However, every person on this planet is guilty of passing judgement on other individuals. Whether the evaluation be made in a local grocery store or in as contentious an environment as a United States courtroom, humans are all guilty of judging individuals by their perceived covers. In an ideal world, legal punishments would reflect officials’ objectivity toward permissible evidence, however, empirical research has revealed additional arbitrary factors.…
