Women and men of the jury, Judge Taylor, people of the court, my defendant Mary Maloney is not guilty of first-degree murder as charged! My client has claimed defense of insanity. On the day of Mr. Maloney’s death Mrs. Maloney was at home waiting for her husband to come home. When Mr. Maloney arrived at home he seemed rather disturbed. On the other hand Mrs. Maloney was happy to see her husband. The Maloney’s usually went out on Thursday nights. According to the police report, on this particular night Mr. Maloney informed her that they would not be going out tonight (Dahl). He told Mrs. Maloney he would be leaving her; but he would send money for her and their unborn child. She ignored him and offered to cook him food several times. Even though he refused she decided on cooking dinner anyways. …show more content…
She acted without thinking. Mrs. Maloney went down stairs and grabbed the first thing she saw out of the freezer. It was the leg of lamb. She then walked upstairs to find her husband standing facing the window with his back towards her. He told her not to make anything that he was leaving. Corresponding with the police report, at this point Mrs. Maloney became angry and without thinking swung at her husband’s head with the leg of lamb (Dahl). My client then realized Mr. Maloney was dead. This was an act of voluntary manslaughter. In this article, voluntary manslaughter is described as a heat of passion crime (Homicide: Murder and Manslaughter). My client committed this crime without thinking. After she committed the crime she went upstairs to fix her makeup to go to the grocery
