In order to determine whether or not an individual is legally intoxicated or under the influence of marijuana, a definition of intoxication must be presented. For the purposes of entering into contracts within the state of Colorado, the definition of being legally intoxicated or under the influence of marijuana is as follows: A person who is incapable of acting in their normal capacity under usual and similar conditions (SOURCE: NOLO). Furthermore, based off of the Colorado state law, a person is considered legally intoxicated (because of marijuana) when they have five or more nanograms per millimeter of blood (SOURCE: COLORADOPOT).
