“EEOC takes the position that any sort of transgender discrimination is sex discrimination, because it inherently involves taking gender—and therefore sex—into account” (Grossman, 2012). A specific example of discrimination based on transgender status is sex discrimination and is a violation of Title VII of the Civil Rights would be the landmark case of Macy v. Holder. Macy, a male transitioning into a woman, applied for a position at a crime lab with the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) (Waguespack, n.d.). She was informed twice by the director that the job was as long as there were no problems with her background check. During the background interview process Macy informed the background check investigator that she was in the process of transitioning from male to …show more content…
She has filed a complaint with the EEOC, which they are considering further legal action against the McDonald’s (Molloy, 2014). Kay claims she was fired from McDonald’s for using the women restroom even though she had been using it the first three months of employment without issue (Molloy, 2014). Kay was confronted by a shift manager and was told that she was not welcome to use the women's restroom, and she should use the men's room from now on. She was later fired after meeting with the general manager (Molloy, 2014).
