An ACP has no legal position. However it does have a legal standing and must be taken in consideration, when someone else is deciding what is in the best interest of the resident, when they lost capacity. If a resident still has capacity, he/she can change the plan any time they wish, as long as they have not lost capacity. We do review ACP regularly, to up-date them. An ACP can be active only if the resident lost capacity and had an ACP in place. Therefore, resident’s wishes can be taken in considerations when taking decisions in their best interest. ACP is evidence of residents’ feelings, wishes, beliefs and values, and they are considered when action are taken on behalf of them.
