The Investigation
There were a variety of components of the criminal justice system involved with the kidnapping of the Lindbergh baby. Some of the information obtained for the case was received by New York Police Department, New Jersey Police and Federal Bureau of Investigation.
The New Jersey State Police became embroiled in jurisdictional battles with New York City Police and the F.B.I. The kidnapping occurred in New Jersey, the child was reported missing from the family’s home.
During the investigation the FBI Director at that time J.E. Hoover informed the New Jersey Police to work with New Jersey State Police, they worked together with Superintendent Colonel H. Norman Schwarzkopf to capture the people involved in the kidnapping. Also at that time the …show more content…
The law is the person is innocent until proven guilty, the initial appearance is to inform Hauptman of the reason for the arrest and his legal rights. The judge will make sure he understands his rights as he makes is decision for pleading guilty or not guilty. Some states can combine the initial appearance of the defendant as well as the arraignment. So it seems there was enough evidence for this case to go to trial. The trial in New York he was charged with extortion in September 1934 and in October 8, 1934 he was indicted for murder, so the Governor of NY granted the Governor of NJ request to transfer Hauptman back to the Hunterdon County Flemington New Jersey to wait for the trial.
The Trial
The trail in Flemington, New Jersey for the Lindbergh case against Hauptman lasted only five weeks. The evidence was circumstantial – based on the match of the marks on the ladder to Hauptman’s tools, wood in the ladder matched the wood of flooring in his attic, handwriting from the ransom notes matched Hauptman handwriting.
