In most legal business establishments such as restaurants, hotels, and other business establishments; workers are only allowed to work a limited number of hours, which does not, exceeds 48 hours per week, which complies with Section two, “Hours of Work,” of Chapter 6. However, if workers are required to work overtime, the overtime hours shall be paid at a rate of fifty percent higher than normal hours and if the overtime hours are worked at night, the rate of increase shall be one hundred percent. Also, hours of work that are extended in order to make up for hours lost that are slowdown from accidental causes or acts of God, cannot be over ten hours per day. For example, if a waiter at Chinese restaurant were to be late for work due to bad weather, act of God, then the worker could make up for the hours lost without getting a deduction of wages. In addition, if the worker is required to work overtime, in a rush hour where there are a lot of customers, depending on the time of day she would be paid accordingly at different rate that are equal to both genders of workers working the same position. One of the main problems is corruption. Corruption exists on many levels and by abolishing corruption; the law would open up to more workers and employers, especially foreign investors that plays an important role in the country’s economic development. Also, by further enforcing the law, especially by using incentives towards the employers such as tax reduction towards materials and products, as well as the creation of Prakas regarding wages that should be kept changing yearly, the economy would grow at a faster paces as there are more materials and legal workforce. In addition, the government should create a committee that further could further improve the Cambodia labor law as there would be new establishments that requires new law to be bounded and also laws which associates workers and technology as the world is advancing at a rapid pace. In conclusion, the Cambodia Labor Law addresses and provides clear description regarding the labor law. In the “Minimal Wage Section,” the section discusses minimum wage, payment of wages, statute of limitation of lawsuits of payment of wages and wage claims in detail.
