Key Points:
The defendant, who was an adult criminal justice ASU student instructed a 17-year-old high school student who was her boyfriend to aid her in committing the felony. The defendant had the juvenile accomplice use his body as a shield so as to block her actions from public view as she made her way around my vehicle to cause the criminal damage. When this occurred, another male had attempted to stop the defendant, but the defendant pushed the male friend away and had her juvenile boyfriend assist her in the crime.
The defendant knowingly made false statements and misrepresented facts to law enforcement about the crime during the criminal investigation. The defendant concocted a false story about the criminal act where she blamed a former boyfriend named “Leo” for the crime. However, he had no involvement in the crime and was blamed by the

Initially, the defendant had lied and made up a story stating how a friend of hers named “Leo” had conducted the felony damage to my vehicle. The defendant stated to me that her friend who was associated with a street gang used a knife to damage my vehicle. The defendant further stated that she had told this person where I park when on campus, showed him a picture of me including a picture of my vehicle. While this story turned out to be a lie by the defendant in order to cover up her actions, for several months this story was the truth to me. I was fearful every time I was on campus that an unknown male who already committed a felony against me may attack me or damage my vehicle again due to the defendant. This fear caused an extreme amount of strain and stress in my life. I went from being an active part of the ASU community to avoiding campus out of fear due to the defendant’s actions and

In the case, Brady v. Maryland 373 U.S. 83, Certiorari was granted to a decision of the Court of Appeals of Maryland to consider whether petitioner was denied a federal right when the appeals court restricted its grant of a new murder trial to the question of punishment, leaving the determination of guilt undisturbed. The appeals court granted a retrial after holding that suppression of evidence by the state violated petitioner's rights under the Due Process Clause, U.S. Constitutional Amendment XIV (Law School Case Briefs, 2013). Furthermore, there was a judgement that had granted the petitioner a new murder trial that was solely based on the issue of his punishment. Since the petitioner was convicted of murder and then sentenced to death in his first trail with the Maryland Court, the petitioner was then informed that the Maryland Courts had withheld a statement that indicated that another individual had admitted that exact homicide. What the Supreme Court had concluded from this case was that, because of the suppression of the evidence was in favorable to an accused upon the request that violated the Due Process Clause required the court to a…

While the “criminal is a child” approach to the juvenile justice system is appealing due to its forgiving nature and emphasis on rehabilitation rather than punishment, there are some cases in which this decision is not so cut-and-dry. One of these instances of a legal “gray area” is the case of Marin Sinzer, who was charged for the murder of Tammy Shevin, 25 years after the crime was committed. The now 38 year old is petitioning to be tried as a juvenile, since he was only 13 at the time of the crime, a year younger than the waiver age at the time. While many proponents of the “criminal is a child” approach take that stance because of the physical and psychological dangers posed to juveniles who are placed in adult prisons, in this unique…
