Juveniles Tried As Adults

There are times when you do something very bad, and never get in trouble for it think about it as a kid you never expect to get in trouble on get punished for your bad doing .The only reason that is because kids are little and don’t know right from wrong . Like once said ''children aren't adults, and therefore it doesn't make it so’’ (Maroney, 2007). they might do some bad things in there little life, but even that as a juvenile kid who has done a bad thing too don’t always get in trouble, but if they do something that is the same thing as adults still they don’t get tried as one only because their brains aren't fully developed and with that they don’t know what's right from wrong. ‘when we trying[juvenile offenders] in the justice system …show more content…
That’s funny because you can’t out a juvenile in jail for what they did and tried them as adults when they can’t even vote or drink because they're age ,and that should apply to them when it comes to a punishment ,but for a kid not as an adult because as one said ''juveniles have develop less mature and responsible and more impulsive, erratic and mostly vulnerable to negative peer pressure therefore, juveniles should not be tried as adults in court''(maroney,2007).Only the reason this can only be used to this topic because they show that even when your kid or a juvenile you can always be peer pressure and soon enough a juvenile can do a bad Thing, and with that yes they are bad kids ,but some of them want to turn that around and be better .in one of the articles it shows '' juveniles violators of the law turn lives around as opposed to older violators is remarkable''(as one of the reporters once said).everybody always wants to make thing better in their lives and as a juvenile you’re going to want that because people already judge you for what you did and if they take the class they need or if they get help they might have a chance in being better in life ,but if you go and tried them as adults you’re going to ruin all hope for them just because of one bad move they did ,and with that the kid might get even worse with ,and that’s not what we want because it'll only get worse not only for them ,but for the whole world that’s why we have criminals it all starts with one bad decision people make for them and trying them as adults isn't the always the answer ''the premise of the juvenile courts system is sound –because juveniles have not matured enough juveniles should not be made accountable to the same standards of accountability as adults ''(cliffsnotes,2009).A lot of the time as kids you don’t see the bad things you do because everything seem to be fine ,but when you do something bad you don’t thing so much of it because you’re not thinking you’re going to get

After the nationwide spike in juvenile crime in the late 1980’s – early 1990’s (when Charlie’s case took place) that lead the states to adopt laws and policies that depraved certain youth of the original juvenile justice system protections, made it easier to move youth from juvenile to adult criminal court, and often placed children with the most severe sentences permitted by law, the McArthur foundation “led many states and courts to view juvenile crime, and juvenile justice, through a developmental lens”. (Juvenile) With recent research, in developmental psychology, on the still developing adolescent brain and how it differs from that of an adult. Because of this courts now often view rehabilitation as their primary goals. Thus often, instead of placing the youth in a juvenile jail, the juvenile is placed on probation, or in an educational and therapeutic program either provided in the youth’s community or in a residential…

Children committing heinous crimes are not a rare occurrence anymore; the upsetting reality requires new tactics for dealing with young juveniles. Some Americans believe children should be tried as adults, yet others feel that they are too young to understand their wrong doings. In most conditions minors are quickly told they are too young or too old for something, however before being sent to an adult facility we need to contemplate all aspects of the case in order to decided whether or not being tried as an adult is necessary. Regardless of the crime, some people feel that an adult facility is not a suitable environment for children to serve their sentences.…

The governor of Connecticut recently proposed raising the age of juvenile jurisdiction to twenty-one as a way of keeping young offenders out of incarceration. In the ensuing debates on whether this is a good idea or not, experts also disputed the appropriate cut off age for juvenile court. Carmen Daugherty, in her article “No One Younger Than 18 Should Be Tried as an Adult,” suggests eighteen as the age limit. She attempts to persuade readers that the practice of trying, sentencing, and incarcerating youth under eighteen in the adult criminal justice system should be terminated as it fails to meet the needs of adolescents. Daugherty appeals to logos to support her claim.…

One reason why juveniles should not receive life in prison without parole is the undeveloped thinking process that occurs. This is further explored in the article, “Startling Finds on Teenage Brains,” by Paul Thompson, an assistant professor of neurology at the University of California, Los Angeles. In the article, Thompson focuses on the cognitive development of the juvenile brain and compares it with the brain of a full grown adult. He uses an example of a juvenile being tried as an adult for second-degree murder to point out how when questioned, the juvenile was unable to give a reason for his actions. He then reports on findings about the teenage brain that he and his research team had discovered.…

The article, “Juveniles Should Be Tried As Adults” by Mary Estudillo, brings up many strong arguments as to why juveniles should be tried as adults, but the opposing article, “Juveniles Should Not Be Tried As Adults” written by Hannah McCrea strongly claims they should not. Estudillo cites examples of cases in which juveniles committed first and second degree murder, and were thereafter tried as adults. She explains how juveniles should be tried as adults because they are criminals, and criminals need to held responsible for their actions. She also brings up how rehabilitation does little to sometimes nothing for the child, so when they are released, they commit another crime. Alternatively, McCrea authored “Juveniles Should Not Be Tried As Adults,” and states how adult prisons do more harm than good for juveniles.…

Juveniles as young as 14 are being positioned in prisons with adults from minimum to maximum prisons. A minimum prison would house offenders who have committed a minor offense such as theft, while a maximum prison house felonies who have engaged in activities such as rape or murder. In 2005, the Supreme Court banned the death penalty ruling “people under 18 are immature, irresponsible, susceptible to peer-pressure and often capable of change (Scott, 2012).” Although, the court recognizes juveniles are immature, irresponsible, and susceptible to peer-pressure yet juveniles remain housed with adults. “For instance, several studies have reported a greater probability of recidivism for juveniles processed in the adult justice system compared with…

Adam Liptak’s article, Locked Away Forever? The Supreme Court Is Considering Whether Life Imprisonment For Teens Offenders Constitutes ‘Cruel and Unusual’ Punishment, asserts that in most cases, “juveniles cross the line, and they have to be treated as adults and punished as adults” (Liptak 14). Age does not determine maturity, nor does it determine responsibility. There is no telling whether someone means it or not when they do something they are not supposed to do. When a child commits murder or rape, people say it is no big deal because they are just kids and were not thinking straight.…

When it comes to the criminal justice system, there are many varying elements that contribute to the process through which accused offenders are counseled. As is expected, there are also numerous moral and ethical disputes that come with the territory, such as whether or not children, or 'juveniles', should be tried as adults in court for the violent crimes they commit. Some may say any child over the age of five should know the difference between right and wrong; for an individual to plan out a crime and act on it, the punishment should fit the offense, no matter the age. However, there is a thin line between vice and neurosis when it comes to juveniles. The incarceration of individuals under the age of sixteen at adult correctional facilities…

In the article “Kids are Kids-until they commit crimes” is about how people say that kids are just kids when they commit a crime. On the other hand, others think that they should be trialed like an adult would be trialed. California’s appeal court stuck it’s nose into quandary to charge young offenders as adults. Some children get sentenced to life without parole. This means that they won’t be able to come out and see their families.…

Growing up I binge watched crime shows, NCIS, Criminal Minds, and Lockdown, you name it I watched it. My interest was always peaked when the shows involved younger people. Somehow this felt more relatable, even though I had never committed a crime and didn’t plan on doing so. It seems that every time a Juvenile commits a crime it is brought to our attention. This got me thinking, is there a level of severity a crime has to reach in order for a juvenile to be tried as an adult.…

She also mentions, “the same malleability that makes them vulnerable to peer pressure also makes them promising candidates for rehabilitation… majority of young offenders grow out of crime” (8-9). Juveniles can grow out of their misbehavior. It is easier to make a juveniles grow into a law-obeying citizen as juveniles are still developing, they can intake the information and understand from the mistake they made as a child. This indicates that anyone under twenty five does not take responsibility for their actions. When it comes to being guilty or not guilty not everyone does take responsibility but they still get their punishment. No matter the age of a individual they should be tried as an adult and have to take responsibility for their own actions whether they want to or not. A juvenile could be given a short sentence and/or just probation and have the idea in their head that they can get away with a crime. The next crime they commit can be far worse and result in harming another individual in…

All eyes were glued to the judge as he said the words that would change the juvenile’s life forever. He was being sentenced to life in prison as a part of a crime he committed with his friends. Many young adolescents some as young as 9 , are being forced to go to prison for long periods of time on an almost daily basis. Minor’s should not be allowed to be tried as adults and to be sentenced to life in prison, as an adult environment would be to brutal for them to cope with. In addition, most kids are very susceptible to peer pressure and often act on impulse in large groups.…

Today, more youths are involved in gangs, murders, and assaults than history has shown. So, if these children are capable of committing adult crimes, shouldn’t they face adult consequences? It seems that the severity of juvenile crime has risen so much, that it is hard to distinct it from adult crimes. On the other hand, most adult offenders we find today, who commit murder or assault are not first time offenders. The unfortunate thing is that a survey given by the Pretrial Services Resource Center found that an astonishing number of juveniles in adult facilities were charged with nonviolent crimes (ABCNews.com: Juveniles in Adult Jails.…

Juveniles should not be tried as adults for it is wrong to hold adolescents, under the legal age, to adult standards. If children do not even receive the same rights as adults in the first place, it makes no sense to try them in adult court. These juveniles should have the opportunity to be rehabilitated in a positive manner, for they tend to come from troubled households and violent neighborhoods. In over half of the cases these troubled kids don’t know any different way than a life of crime when surrounded by both social and environmental factors that influence their delinquent actions. One must commemorate that juveniles are mentally underdeveloped, and still have time to innovate if their issues are dealt with precisely and accurately.…
