Just Justice: Is a fair trial really fair?
According to the article, 5 Ways America's Justice System Is Designed To Screw You posted to Cracked.com on January 28, 2015, by Talia Jane there are several ways that the American justice system is set up to fail you. Ms. Jane, a professional writer, wrote this article along with an anonymous expert source, that she claims is a former public defender who wished to go unnamed. Lane says that without proper representation and sometime even with it the cards are stacked against the unfortunate person on trial. Now if you are fortunate enough to be able to afford a higher cost lawyer that doesn’t necessarily mean that are better prepared to defend you. Though public defenders may seem less experienced overall, they may actually be more experienced when it comes to actual criminal cases. Remember those caseloads? All of those cases in a short period of time means that the Public defenders while on the job went through way more criminal cases than a lawyer who simply practiced family law. After researching the author, the only thing that I could find on Talia Lane is that she is a professional writer. As a professional writer, and not a person with a law degree herself, she would get paid by the story and therefore this may have been just another paycheck as opposed to something she had a legitimate concern for. This is not to say that she doesn’t have an earnest reason to write the story, it simply puts into perspective a reason to why she might have. While I want to understand where she is coming from she presents no evidence on why her information should be believed.
What about her expert contributor? According to her, the expert is a former Public Defender. Without a name or background that can be researched, an anonymous source is fraught with open-ended doubt to the reliability of the source or whether or not the person even exists.
