John Enzenaur began feeling sick the week of Christmas that Monday. When his symptoms had not slowed down by Saturday he went to urgent care. During his visit they drew blood and told him he had a flu, they told him to go home. The next day, the day before Christmas urgent care doctor called to ask him to go to the emergency room, if he was still feeling ill. After they conducted another blood test the doctors told him he was bleeding internally, anemic, and had a bladder infection. After they told him all of that they sent him home and said he would be just fine. John suffered sweats and chills the night he went home and had trouble breathing. Christmas comes and goes and on the morning of the 26th, Cyndi, John’s wife awakes to him screaming. John arrives at the ER at 7 a.m. and 2:30 p.m. he is suffering with pneumonia in the ICU. He went into septic shock, and his body was shutting down. John went on life support that day. Cyndi received a phone call at 3:30 a.m. telling her john had died.

Christmas Day. They were not in his chart on the 26th at 7:30 a.m. Cyndi sued the hospital and three doctors. The case was settled two years later, with the swing shift, the day doctor and the hospital being held liable for misdiagnosing John’s condition. With MICRA’s limit on the non-economic damages the family did not receive enough to cover their expenses. A formula decided John would retire at 57 so the award was smaller. The formula also took away 23 percent of the settlement that would have been John’s personal money, since he is not here to spend
