Jay Carlos Case Summary

In this case there is an owner Jay Carlos is faced with a major dilemma. He has opened up a business that house the mental retarded and he learned that he is not prepared to handle the heat that is coming from OSHA. The representative comes to the facility and he thinks that his contacts including his attorney have the power to override the demands of the OSHA representative. In the 1970’s when things started to change he learned that in order to operate that facility he needs to provide state important documents required for state compliance failure to do so could result in fines. He refused to let the OSHA representative in unless he had a search warrant. He not only returned with a warrant but bought six representatives along with him to investigate. OSHA is trying to make them meet a compliance factor that does not apply to them because none of their patients are at risk. His state contacts contacted him and said; “Were staying out of it, Period! And that’s from the top”. He also contacted Warren Belle at New Horizon Homes an East Hampshire competitor which he gave them one simple word of advice; “Do whatever they ask you to do. Do it now. Do it exactly the way they ask you to do it. Do it no matter how much it cost. Don’t fight. And don’t listen to you lawyer”. This …show more content…
These operations can cost a company very large fines. In the article it states that one of the competitors was fined for not posting detailed lists of chemicals and cleaning supplies that get used on a daily basis. Jay should work with OSHA. I feel that he should not use his lawyer as first line of defense but find out exactly what he needs to do to get it right. Jay should only use his attorney for his rights and to possibly stop the harassment and to keep them from receiving fines that they did not deserve. No one deserves to be bullied and that
