Is It Acceptable To Break The Law Essay

Is it acceptable to break the law under certain circumstances? Law is defined as; the system of rules that a particular country or community recognizes as regulating the actions of its members and may enforce by the imposition of penalties. It should be acceptable to bend the law if it is used for good intentions. Laws are meant to keep people safe, but under certain conditions they are over controlling, and they need to be broken. It can be beneficial or even life saving at times to break the law, but it is not acceptable to break the law at all times. There are exceptions to the law, and they need to be recognized when the time is right. Imagine if a government started to kill its own people in an uncontrollable and psychotic manner. This would be a time where the people would have to rebel, or fight back, against the governing body in control. The law would be broken because attacks to this scale would be illegal, but it is all in an effort to save harmless civilians being murdered by an irrational higher power. If the innocent people do not break the law and fight back, then more innocent people die and it creates a more unsafe environment. The law needs to be …show more content…
These people believe that the law is too threatening to find any loophole for the greater safety of people. However, these people do not see that there are justifications to the law in some cases that are positive and are for the good/safety of people. For example, driving over the speed limit, or recklessly, to rush someone in critical condition to the hospital would be a time when justifying the law would be acceptable with the intention of saving a life. The driving illegally for someone’s safety would also be acceptable if a woman is in labor and needs to get to the hospital as quickly as possible before she gives birth. This is why the law is acceptable to bend at specific times for the safety of

It is justified to break the law, particularly when the law being broken is unjust and immoral. An example of unjust and corrupt laws is the laws made in Nazi Germany. (King, 4) Plenty of these laws obliged people to report Jews for them to be terminated from Society. To oppose and break Nazi’s manmade law and help the Jews would be the moral and right thing to do. As a result, I assume that the only answer to the question of when is it justifiable to break a law is when that law violates more fundamental laws that maintain key human rights.…

When Election Day comes around, everyone that is registered to vote does so because they feel as though they should have a say in who is in charge of the country they live in. The question is, is voting a right as a human being or a right as a citizen? Do people do it because they believe by voting they can pick the person they like for themselves or is it an act as a citizen to pick the better person who would make the country a better place? Would people still vote if they knew the two candidates were equally bad for the country? Would they still feel obligated to vote as a citizen?…

In H.L. Mencken’s writing, he explains how “the average man does not want to be free, but wants to be safe.” BUt freedom is not only more important, but necessary for safety of the individual and the society. THroughout history there are many example of societies and even nations that attempted the idea of “public safety” over individual freedom. In ideology, it sounds as if it would work, but if you take the deffinition of that idea, it is communism, which has shown to fail. The biggest example of this is the SOviet Union.…

Conscience saves Souls Man makes mistakes, man-made law might be a product of mistakes. Disobey the law when your conscience tells you the law is unjust and against humanity. Dr. Martin Luther King Jr. writes, “an unjust law is a human law that is not rooted in eternal and natural law” (King). Authorities always create the unjust law and cover them with beautiful lies to fake them as just laws, then trick the people to obey them.…

One point in Malcolm Gladwell’s book that stood out to me was when he talked about the artist in Paris in 1860 and how they didn’t conform, which I think you shouldn’t. He quoted historian Sue Roe when she wrote, “works were expected to be microscopically accurate, properly ‘finished’ and formally framed, with proper perspective and all the familiar artistic conventions (pg. 66),” but the artists he wrote about didn’t follow those rules. His book is about underdogs but, when he wrote about the artists and how they were painting different than what was liked back then, I thought it was more about how the underdogs of the time didn’t conform to society. He wrote, “the Impressionists had an entirely different idea about what constituted art.…

Another site of legal violence is within mass incarceration. William Stunz addresses the violence of the system as focusing on the process over the outcome. He focuses on how the law was put into place to create the desired outcomes, rather than looking at the results to create the law. This focus on the process means there is no inquiry to whether material outcomes of the process are actually just and as such it appears that the system does not want to fix the problem, but rather just emphasize an existing problem. This is a systemic violence because the way the way the law is interpreted causes the focus on procedure rather than the outcomes (Gopnik 2012).…

Most people would agree that laws are something that were created to help people. Most of the help is figuring out who is right, how to handle something, or rules to follow (Behl, 2016). Hardly anyone would argue that this is a bad thing, until the law itself breaks the rules. Many laws can, in fact, contradict themselves. An example of this is the juvenile justice system and being able to wave the juvenile to adult court.…

“One who breaks an unjust law must do so openly, lovingly, and with a willingness to accept the penalty” -Martin Luther King Jr. Martin Luther King Jr. argues in “Letter from a Birmingham Jail” that it is our duty to break a law if it is unfair. King advocates disobeying a country’s prejudice laws in order to avoid immorality. Similarly, Henry David Thoreau argues in “Civil Disobedience” that if a law requires a person to be unjust to another, they should break it.…

When it comes to the topic of laws, most of us will readily agree that breaking the laws is unjust. Where this agreement usually ends, however, is on the question of if there is ever a time when a law can acceptably be broken. Whereas some are convinced that laws should never be broken, others maintain that there are some instances where laws should be broken. Socrates and Antigone would agree with the statement that disobeying laws is never the answer. Likewise, I have always believed that breaking the laws should be punishable and should never be done.…

In fact, according to me we have a “prima facie” duty to obey laws. If the law is legally enacted by an authorised entity it is valid in the legal system. Therefore, the law is applied and obeyed by citizens. In other words, “law is to be obeyed because it is the law” . However, “prima facie” means that “it is accepted as correct until proved otherwise” .…
