Involuntary Manslaughter

Decent Essays
Manslaughter is only one step down from murder. Based on the circumstances involved, manslaughter may be labeled as "involuntary." If it becomes clear the the killing of another person was purely unintentional, they may be charged with this slightly lesser crime. In most cases the penalties are less severe that the penalties for those convicted of murder. However, that does not mean that the consequences for involuntary manslaughter are not severe.

Involuntary manslaughter falls into three main categories. Each is treated differently by the courts, and often times falls into unclear territory. The courts and prosecution lawyers will decide what charges best suit the situation.

In my opinion limiting the power of the police to use deadly force would not make their job more difficult. My belief is based in part on the fact that not all situations call for the use of deadly force and sometimes it is the officer’s reaction that results in their use of deadly and not the action of the suspect. For example, Officer Betty Shelby claimed that she was temporarily death when she shot the unarmed Terence Crutcher (Wagner & Wagner, 2016). It wasn’t so much Terence Crutcher’s actions as his hands were visible and he was surrounded by other officers when he was shot and killed.…

In common law murder had one classification, and a majority of states have divided murder into degrees, which include first and second-degree murder (Hall, 2015). First-degree murder is the most severe crime and for a murder to be classified as first-degree there must be proof that the homicide was willful, deliberate, and premeditated (Hall, 2015). To truly understand the difference between first-degree murder and second-degree murder we must identify the legal definitions of willful, deliberate, and premeditated beginning with willful. Willful is legally defined by the defendant had the intention to cause death (Hall, 2015). Next, deliberate refers to the defendant’s mental state, which means he or she possessed a cool mind and did not…

Is assisted suicide people’s right or a mistake (wrong)? Assisted suicide is the act of deliberately assisting another person to kill themselves to relieve suffering. As proof, if a relative of a person with a terminal illness were to obtain powerful sedatives, knowing that the person intended to take an overdose of sedatives to kill themselves, it is considered an assisting suicide. Therefore, people should be given the right of assisted suicide in order to end their pain and suffering, avoid damaging financial effects of medical services on their families, and preserve the individual right of people to determine their own fate. Assisted suicide should be legalized in all countries to help people with terminal illnesses, for they have the…

A good death in Latin or, more commonly, euthanasia, holds that in extreme cases intentionally causing death can be positive if it reduces pain and causes a benefit to those who suffer. Euthanasia has many forms to include involuntary, voluntary, assisted, active and passive. The ethical view of euthanasia is widely debated and before one is able to look at the ethical stance of euthanasia one must first discuss its forms. To begin, involuntary euthanasia refers to a patient who is incapable of giving permission to the medical personnel in order to authorize their death (MacKinnon & Fiala 2015).…

Manslaughter can be voluntary or involuntary. Voluntary manslaughter can be seen as very similar to murder except in that voluntary manslaughter does not involve premeditation nor evil motivation. Voluntary manslaughter happens in the heat of the moment after adequate provocation—that is, provocation which is likely to cause a reasonable person to lose self-control for a small period of time. Voluntary manslaughter in popular culture is sometimes called ‘crimes of passion’. Examples include a person who shoots their spouse’s lover after coming home and discovering them in the act, individuals who shoots a person immediately after…
