Capitalism has eventually entrenched the conception of substantive equality in our society. This is the concept of understanding social contexts that recognize that oppressions and disadvantages in society are realities (Rosenfel, 1986, p. 1687). As a result of this type of thinking, those who are in a lower class will not be treated the same. This notion perpetuates that the playing field is not level and rather than establishing all members of society with having “equal opportunity” of achieving the same goals as others, it creates a major divide between the opportunities that are given to some and out of reach for others (Rosenfel, 1986, p. 1687). In relation to Rosenfel’s description of substantive equality, Majury argues that substantive equality “addresses the new mutations and shifting manifestations of inequality as well as deeply entrenches systemic inequalities” (Majury, 2006, p. 5). Through this analysis, we can see a clear line drawn between the creation and sustainability of poverty, ultimately concluding that the state is of heavy influence on how the working poor and unemployed are treated in society. Through the analysis of how society is structured, we can recognize that the perseverance of poverty means that our society is not as advanced and developed as we believed.By understanding and critically analyzing the working poor’s relationship with the organization of society, role of the state and lack of access and assistance, it is evident that there is a great intersection between how law can affect society in abstract ways. Not only does law and subjectivity intersect with poverty, but many other factors that were not discussed in this paper are also greatly beneficial to the quality of life that an individual can maintain.
