Informative Interview Paper

I recently had an opportunity to perform an informative interview with William Payne of Payne Law. I am pursuing my AAS degree in Legal Administrative Office Systems, and wanted more information on what was really happening when they weren’t in front of the court systems. I am in a Legal Terminology class, and really wished to combine what I am currently learning here, with what I’m planning for my future. After this interview I felt more prepared for what is to come in later years. I’m more excited than ever about my career pathway.

Key Findings:

In the hour with them that I was honored with, I saw that they were not just being driven by money. They will be upfront with clients if they don’t feel like they have a case or if they should take certain deals. I believed that they would still take cases even if they were going to lose, and charge the client fees. They have great ethics in their business.
I also learned that they can be picky about which cases they want to take, purely based off interest. William Payne personally doesn’t like to take malpractice cases, where clients are suing their medical provider for wrongdoing, or property line disputes. My previous thought was they couldn’t turn away clients without a reasonable cause, similar to firing an employee.
The legal assistant was informing me of her duties. She is a little different than a paralegal, but still performs extensive research pertaining to cases. The Attorney then has to sign off on her research, which takes the liability off of her and puts it on him, so if there are any mistakes she would not be held liable, he would. It was helpful to my future to find out this information about how Legal ethics work.

Being from a country with a legal system that is a product of combining civil, Islamic & customary law, going to a courtroom and observing a case seemed like a very unnatural and intimidating task. Having no exposure to courts with the exception of dramatized television shows, I expected all who worked in the court to be big scary officials. This idea was proven to be quite the myth when the judge of the murder case I observed dismissed certain issues presented by lawyers with a casual “Peace” or “I don’t want any drama, man.” My peers and I were very confused soon after our arrival to the superior court, as we were intending on observing the famous Michelle Lodzinski murder case, however different employees seemed to have contradicting information concerning the case, varying from a simple “there are no cases going on”, to a “You should…

Attorneys as Negotiators Another role attorneys commonly fulfill in the United States is that of a negotiator. This is a role they play while also acting as an advocate since when the attorneys are fulfilling this role they are negotiating on behalf of their clients. Negotiation is defined in Merriam-Webster Dictionary as “a formal discussion between people who are trying to reach an agreement” (Merriam-Webster, n.d.) The role of being a negotiator, or trying to reach an agreement in the case, is a significant one for an attorney because it is popular to settle cases rather than go to trial in both criminal and civil proceedings.…

They are paternalistic to influence clients to take the wisest course of practical action. However, this stance has a great deal of uncertainty. It should be noted that not every lawyer has the same lay-morality and perceptions of ethical and unethical. Even still, some solicitors may not personally care that the action pursued is unethical. Thus, if we do allow personal mortality into the lawyer’s role, this may put some clients at a disadvantage regarding the extent to which a lawyer may pursue their interests as it would be contingent on the individual lawyer’s personal morality, and import great uncertainty.…
