I am writing to provide you with an updated status concerning the above-referenced industrial injury case.

Applicant’s Attorney’s Request for a Supplemental Report from Panel Qualified Medical Evaluator, Dr. Timothy Brox

As you may recall, a letter was sent to the applicant’s attorney’s office requesting the status of the request for a supplemental report from PQME, Dr. Brox. In our letter, I indicated if no response was received within 30 days of the letter, we would be filing a Declaration of Readiness to Proceed to a Mandatory Settlement Conference based on the reporting of Dr. Brox. No response has been received from the applicant’s attorney’s office. Therefore, we will proceed with filing the DOR in our file.

Guerrero for an orthopedic consultation. Dr. Guerrero diagnosed the applicant with impingement syndrome of the right shoulder and a superior glenoid labrum lesion of the right shoulder. Dr. Guerrero recommended non-surgical treatment at this time. Dr. Guerrero indicated the significant bursitis may not be a result of the Slap tear, but rather a product of her age. Based on this fact, Dr. Guerrero recommended a subacromial steroid injection to see if it could improve the applicant’s pain. Dr. Guerrero also, wanted to request physical therapy for the applicant to work on deep tissue release, scapular mobilization, stabilization, and muscular balance. After discussing the treatment plan with the applicant, the applicant was given a steroid injection in the right shoulder. The applicant was set for a re-evaluation in six weeks.

The applicant was evaluated by Dr. Robson on March 21, 2017. Based on Dr. Guerrero’s recommendation, Dr. Robson placed the applicant on physical therapy two times a week for six weeks. After the completion of the physical therapy, Dr. Guerrero will be making a recommendation on whether surgery will be necessary.

Plan of Action for Further Handling

Please continue to provide me with updated medical reports for the applicant, specifically in light of Dr. Robson and Dr. Guerrero’s indications that surgery on the right shoulder may be necessary.

As previously noted, the DOR to a MSC has been filed.

I explained to him based on the doctors reports I would file an objection to the Proposed Decision and we would argue this treatment was related whether or not we are going to amend the case.
