FBI investigation into FIR No. 298/1998 led to chargesheet of 12 persons under various provisions of Arms Act, IPC, TADA. All accused were sentenced to death by Special Court and the same was confirmed by the High Court. An appeal was filed in High Court of Panchtara but same was rejected. Subsequent appeal was dismissed in Supreme Court as disposed off in 2005. Immediately, accused filed the mercy petition under Article 161 and subsequently under Article 72 before the President of Indradhwaja which were April 2014. All accused filed petitions before the Supreme Court for commutation, on the ground of inordinate delay in disposal of mercy petitions. The Supreme Court remitted the sentence by its order dated 30th January 2015. After the said order Panchtara state, by a letter wrote to Federal Government as required under CrPC that it proposes to remit the sentences of all convicts, on a ground that the 16 years of incarceration is enough as life …show more content…
FIR No. 219/1998 was investigated by the State Police of Hansa and chargesheet was filed against 7 persons including Rimpo and Hardo. They were charged with offences under the Arms Act, Explosive Substances Act and IPC for various offences planning, abetting, conspiring and the murder of 3000 innocent persons. The trial court sentenced all to life imprisonment. The High Court disallowed the cross appeals filed by the state and the convicts. On appeal, Supreme Court’s three judge bench held that the crime is so grievous that accused were of special category of offenders that is beyond remission and sentenced to imprisonment till life ends. Union of Indradhwaja filed review petition in Supreme Court of Indradhwaja against the order. After letter dated 4th February 2015 become public, on 6th February 2015, State of Hansa wrote a letter to State of Panchtara contending that Rimpo and Hardo have been sentenced to imprisonment for life till life ends with no remission by the Supreme Court of India in case registered under FIR No. 219/1998 in the State of Hansa. Thereafter, a PIL was filed in Supreme Court of Indradhwaja for securing the release of Rimpo and Hardo on the ground that they have already suffered more than 15 years in jail.
