The Independence Of The Judiciary : The laws of Islam , through it’s basic principles and sacred texts prohibits government officials from interfering in the matters of court and judges , they must respect respect their decisions inspite of becoming a hurdle for them . Islamic law in its individual statutes and general principles , tells us to realize its primary objective to establish justice on the basis of monotheism , it (monotheism) is not just lip service . 1- Muslims are totally responsible for what they do whether he or she and will get the punishment of committed crime as enforced by the state , this system is very necessary because it not only protects the society but if we receive punishment of the committed crime from the court of Shari’ah it will remove the afterlife punishment of that crime , Muslims must remember that Allah (swt) knows each and every of their actions . This is why it’s better to get punishment in the world and repent because the punishment of afterlife is much more severe than the world’s and that is hellfire . Many of the Muslims during Muhammad (peace be upon him) time confessed their crimes which were severely punishable and they knew it but they did so because they did not want to get the punishment of those crimes at The Day Of Judgement . It is narrated by Abu Daud that when a man confessed that he had committed an illegal sexual act and was ordered to be stoned to death The Prophet Muhammad (peace be upn him) said : “He is more agreeable than the fragrance of musk in the eyes of Allah” …show more content…
They never tried to turn the favour of court towards them or towards those whome they liked . Even if the decision of judiciary comes against them they accept it with due respect . The books of history are full with narrations showing that the judges appointed by the Rightly Guided Caliphs or by the later governors ruled against them . Some times Caliphs knew that what the truthful outcome would be or should be but even of that they allowed the cases to go to the court to set an example of conduct for us . They also do so to test the strength of the appointed judges while in such a situation when their adversary might be even a Jew or other non-Muslim . The judge in is court room was the most respected one , due to criticism he would not sway from the truth and he would treat whether it would be prince or a pauper equally . The books of history give many examples of as such .
