One of the necessary elements of some crimes is mens rea . This is a Latin term that means “intending mind”. From the definition you can tell this is the mental element of an offense. Mens rea can be viewed from different perspectives that vary in their degree of magnitude. The offense of killing a man can incur a wide range of punishment, depending entirely on what level of mens rea is found present in the criminal's mind at the time the crime was committed. The difference between gross negligence and deliberate intention in this case could be the difference between a few years in prison and capital punishment. . If you accidentally murder someone while in a fit of passion without malicious forethought, the court will account for this in their sentencing.
