Criminal Evidence/Criminal Law
The murder weapon was not recovered. Witness said she saw McDonald throw it on the ground when running away, but no murder weapon was taken into evidence (Pasulka, 2012). However, there was a three-quarter-inch puncture wound in Schmitz chest that ripped more than three inches into his body cavity, all the way to the right ventricle of his heart (Mannix, 2012). When the ambulance came, Schmitz was barely breathing. He died in the ambulance on his way to the hospital. Though no murder weapon was found, it was said that the weapon might have been small like a knife or scissor. Cece McDonald confessed to stabbing Schmitz with her fabric scissors that she uses at school (Pasulka, 2012).

Informal social control is the tool we use to control our behavior in every social encounter; within our families, friends, neighbors, and organization. It is pretty much our social norms. Dean Schmitz and his friends went away from informal social control; our social norm is not to be rude and make negative comments to others, but to Schmitz, he seemed okay to harass the group for being transgender and "black". People just do not go around and harass other people; it is not part of our norm. Schmitz went against society 's norms and made fun of the group, but in some way, he was giving negative comments to the group, to tell them to change their behavior, to stop dressing and acting like the opposite gender that they are, and to start to become what he thinks should be normal in society. What he doesn 't understand is that social norms change every time, it is okay to be openly gay/lesbian/transgender, our society accepts it more, but he still doesn 't seem to accept it. As for Molly Flaherty, she went against formal social control. We have laws and regulation that conform formal social control. We have to act some way and not violate the norms, if we do; formal social control is issued as a way to address those who violate the law. Formal social control is used so we do not commit a crime. Flaherty violated the law and harmed an individual. She slashed McDonald with a glass, bringing harm to another person. As a result, it brought the group to lash out and go against formal social control, and instead of walking away and calling the police as a formal social control reaction, they attacked as well. It made McDonald react as she did, she had the opportunity to walk away but she stayed where she was and attack Schmitz. McDonald and her friends just reacted the same way as Schmitz and his friends first reacted to them, which is not part of a social

The shot was close range through the skull above the ear. The gun was close enough to her head that it left gun residue on the flesh and burn impressions. It was a penetrating wound because the bullet did not have an exit wound, but the bones did shatter and the bullet remained to travel in a straight line instead of deflecting elsewhere into the skull. From the hard-contact wound observed at the autopsy, gunpowder residue left ‘tattooing’ and powder was able to be recovered and taken into evidence as well as the diameter of the gun barrel was measured from the head injury. Inside the wound track, soot and unburnt powder were also taken for evidence by cue tip to be tested later in the labs.…

Society’s non-acceptance will fall and pave a day for a better future. Society expects individuals to conform to the “standard story,” as coined by Judy Aulette and Judith Wittner, where sex is binary (male or female) and sexuality is assumed to be heterosexual, where an individual may wish to identify otherwise (GW pp. 20). This expectation is exhibited in Jacob Anderson-Minshall’s The Enemy Within: On Becoming A Straight White Guy, where because he grew up as a “tomboy” female, he was interrogated by his school because he did not align with the expectation of his biological sex (pp. 28-33). This simply perpetuates the fact that society expects the “standard story.”…

Medical examiners found her neck was cut so deeply that her vertebra C3 was cut. When investigating a violent attack or a murder, wound pattern analysis can provide additional information about the crime. For example, if a weapon came from the scene then it could possibly mean the attack was spontaneous and unplanned. In this case the preservation, documentation, examination and the ability to replicate the weapon that caused the wound could provide the police with details about the offender. The wounds on the victims were likely the result of a single-edged knife about 6 inches long.…

In the age of mass incarceration, a failed criminal justice system has left the United States with the largest imprisoned population in the world. There are many different elements that have helped play a part in this flawed criminalization regime which can all be traced back to the early history of the country. The 14th amendment though serving as a protection for citizens has with the addition of the war on crime helped disenfranchise much of the population in turn giving whites surrounding prisons unanticipated power. It is the creation of power relations throughout the country 's history that have helped cement the current criminal justice system into what it is today. Power relations such as the concept of “Property”, “Social death”, and…

Background On February 23th 1957 a young man was checking up on his muskrat traps around a dirty, abandoned area and spotted the dead boy inside the box, yet he refused to tell the police because he knew those traps were illegal so he wanted to save himself fromthe trouble. Two days later on February 25th 1957 a college student traveling along Susquehanna Road in Philadelphia spotted a box with “Furniture, Fragile, do not open with knife” written on it with red letters. The traveler found a corpse of a little boy who was naked wrapped in a Navajo blanket, which is a blanket from the Native Americans who weave these as a tradition to represent their culture. He was 40 inches and weighed about 30 pounds. He was a white boy with blue eyes and blonde hair, anywhere from 3 to 6 years old, it seemed as if is nails were carefully trimmed and haircut was sharp and close to the head as if it was hurried in order to cover the little boy’s identity, probably done at home.…

Children, throughout history, have been considered a symbol of youthful innocence. They live stress-free lives and are forgiven for any mistakes they commit because they cannot distinguish between right and wrong. A criminal is a person who knowingly, or unknowingly, breaks a law that is put in place to hold society together, and to keep it functioning at its highest capacity. Criminals, to some, are the scum of society, acting on instinct and having no remorse for their actions.…

When society looks at crime offenders, most people assume that the offenders are breaking the law because they come from a broken home, are of non-white ethnic background, live in poverty and belong to a gang. While some of these are true, others are not. Why do people commit crimes in the first place, what makes them think that is ok behavior or is this even preventable behavior that society can stop? These are great questions, which makes this essay take a closer look at how the influence of socialization can affect crime. Could it be that anybody is prone to crime, and could improper socialization have anything to do with the crime itself.…
