How Do Drug Use, Prostitution And Gambling Fit The Seven Elements Of Crime

Improved Essays
In my opinion, I don’t believe that drug use, prostitution, or gambling fits the seven elements of crime except for legality and punishment. As I read the definition for each of the seven elements of the crime, I compared each to drug use, prostitution, and gambling. However, first for you to understand and for me explain my stance, you should know the legal definition of the crime. The legal definition is the “Intentional violation of Criminal Law, committed without defense or excuse and penalized by the state” (Bohm, Haley, 2012, pp.29). Initially each of these is prohibited by law, however, most don't fit the elements of the crime. Harm doesn’t fit because they are not harming another individual, however, drugs might affect them personally,

Q.1. 1 [250 words] Name three major problems with the concept of crime as criminal behaviour. “Criminal behaviour is defined by the laws of particular jurisdictions, and there are sometimes vast differences between and even within countries regarding what types of behaviour are prohibited”. (Edge, 2016). One of the key problems is that throughout the world many countries consider some criminal acts to be more serious than others for example marijuana is an illegal drug in Ireland but is legal in Alaska.…

Over the years, criminologists have endeavoured to explain the causes and suggest solutions for youth criminal behaviour, through the use of criminological models. Pre-modern explanations were rejected by new theories because these theories fundamentally believed in rationality and humanitarianism. The purpose of pre-modern explanations was to identify, a connection between the individual and society; the reasons for disorder and an implementation of sanctions of those individuals who breached the existing norms of behaviour. Most pre-modern explanations relied upon spiritualism and naturalism. The modern models were criminological theories which were developed during the period of industrial modernity to explain offending behaviour.…

Why people commit crime can be a very thought question, and maybe impossible to answer without some concepts. “Theories are devised to explain how a number of different correlates may actually be causally related to criminal behavior rather than simply associated with it." Anthony, W. (2012) Criminology, page 13. Theories of Crime brought lights on a various causes and reasons for crime such as poor parental, birth on financial hardship, and birth defects. Other reasons provided are genetic, psychological, and environmental; example, a mother on drugs and father’s cell compromised by drug use, lack of food, hunger, poor education, and all of these negatives things can influence someone to commit crimes.…

A lot of people who become physically and mentally dependent on drugs commit statutory, inchoate, property or even personal crimes in order to obtain drugs. The article “Lindsay Lohan Biography” states, “On May 26, 2007, Lohan was arrested after crashing her Mercedes-Benz into a tree in Beverly Hills. She was arrested again July 24 in Santa Monica after she allegedly engaged in a car chase with the mother of her former personal assistant. In both cases, Lohan was found in possession of small amounts of cocaine.” In other words, this article is expressing how drug abusers commit more crimes than just the standard possession and sale of drugs.…

People use drugs to get away from their problems, but their problem will still be there. Domestic violence, accidents, injuries, and death can also occur. Most of crime is caused by drug users or drug related. Drug abuse must be stopped if society contributes more by making pharmacies help more, making it illegal in states, and more drug enforcement. Drug abuse can be using prescribed drugs the wrong way.…

Sociology Personal Statement I first became hooked by sociology when I started it back in GCSE years, and since then I have realised that the world we live in isn’t quite as simple as we once thought it was, and how society can be affected by different things in different ways. I wish to be able to know, how a person can act differently in one area than somebody from a different area, also how the society in which somebody is socialised can cause them to turn to crime whether it be through material deprivation or pressure from their peers. My favourite area of Sociology to learn about is Crime, I am so interested in the ways in which crime can affect our lives in both bad and good ways, and also learn how something that can be perceived as a crime to one person can be seen as perfectly acceptable to another. I carried Sociology onto A-Level and this just went further into detail on the things that I was interested and I can’t wait to be able to go even deeper into why things happen in a society the way that they do.…

In Elliott Currie’s article, “Toward a Policy on Drugs,” (1993) he expresses drug policy in the United States, and provides evidence to support his beliefs on the matter. Currie (1993) says that the police can only do so much to stop the problem, and that the people must speak up for how they want the problem solved (p. 571). In the first few paragraphs, he states that punishment of drug users is not an effective way to end the drug problem. He goes on to say that we must instead rehabilitate drug users, and reintegrate them into society. In other countries, they take an approach not unlike this one, and as such have seen a considerable reduction in drug abuse.…

Introduction “He who does not prevent a crime when he can, encourages it”, a quote from Lucius Annaeus Seneca that helps describe how society views and “prevents” crime. Criminal theories attempt to construct views on how to prevent and fight crime but often the criminal justice system is working against society. The two theories that are explained within are the social learning theory and rational choice theory. These theories will construct views as to how and why the seven crimes are committed using the concepts within the theories.…
