On Thursday, September 22nd at 4:00 p.m., I witnessed the Beebe v. Bozeman Deaconess Health Service, Inc. court case. The judge for this case was Judge Holly Brown. I walked into the court room while they were on recess, so I was a little confused about what was going on at first. It was interesting to be a part of the “please rise” standing ritual when the judge walked in. It makes a person wonder why the benches in the public’s seating area are so noisy, it seemed very disruptive.…

Bukowski v. Clarkson University In 2012, the case of Bukowski v. Clarkson University made it all the way to the highest New York state court. This case involved the plaintiff, Shawn Bukowski, suing his school on the grounds of negligence by the defendant (Lippman, 2012). Shawn Bukowski was a pitcher for the baseball team at Clarkson University, where, during an indoor practice, was hit by a line drive in the jaw and sustained an injury. Bukowski felt that Clarkson University and their baseball coach had acted negligently and put him in unreasonable risk of harm, because there were conditions on the field that enhanced his risk to sustaining this type of injury (Lippman, 2012).…

The students believed their right to free speech under the first amendment was violated. Reynolds however believed he was protecting the students privacy since the journalism class had asked students for their experience on the topics and published it.…

In Daniels’s memorandum, he argues that a trial court granted a general contractor’s motion for summary judgment because a general contractor has no duty of care to the injured party. Williams v. Nucor-Yamato Steel Col., 886 S.W.2d 587, 587 (Ark. 1994). This argument would be compelling but for a lack of evidence in the record reflecting Bolanos’s status as an independent contractor. In fact, the only evidence that supports Daniels’s assertion is his own affidavit. Deferring consideration of Daniels’s motion until after Bolanos and Daniels are deposed will “provide an additional safeguard against an improvident or premature grant of summary judgment.”…

In his complaint, Kaye alleged that by filing her complaint, Wilson-Gaskins breached the Release contained in the parties’ settlement agreement, she breached the implied covenant of good faith and fair dealing, and that she was anticipating further breaches of the contract. In response, Wilson-Gaskins, filed a motion to dismiss Kaye’s claims for breach of the Release, and breach of the implied covenant of good faith and fair dealing. Additionally, Kaye filed a motion for partial summary judgment, claiming that our prior opinion affirmatively established Wilson-Gaskins’s liability as the law of the case. Following two hearings, the circuit court found that although the Release absolved Kaye of liability for conduct within the scope of the agreement, the agreement did not provide Kaye with an affirmative cause of action to pursue against Wilson-Gaskins for damages. Accordingly, the circuit court granted Wilson-Gaskins’s motion to dismiss counts one and two of Kaye’s…
