1. Type of homicide.
The type of homicide in the Simon Grittany case is Intimate Partner homicide. Daniel G. Saunders and Angela Browne (2000) “Intimate partner homicide is murder that occurs between current or former dating, cohabiting or common law or married couples.” Fiona Brookman (2005) Most intimate partner homicides are a result of a long history of domestic violence, when males kill a female intimate partner it is often as a result of them trying to gain control of the female partner but when a female kills a male partner it is to gain control back of themselves after a history of domestic violence at the hands of the male partner. Gittany at the time of sentencing was 40 year old (Sunday night (2014) Lebanese male born (R v Gittany (No 5) [2014] Gittany was one of six children raised by a close knit family in the Sydney suburb of Merrylands. Gittany had a few run in with the law, starting when he was(R v Gittany (No 5) [2014] 18 years old when he was put on a good behaviour bond for assault occasioning actual bodily harm. At 21 Gittany found himself in trouble again and was convicted of an offense for obtaining stolen goods, assaulting a police officer and malicious wounding and sentenced to 2.5 years imprisonment which was appealed and the sentence was dismissed. After this incident Gittany decided to turn to religion and joined the Catholic Church in France but returned to Australia decided it was not for him. In 2001 Gittany was convicted of supplying a prohibited drug and possession of stolen goods. Dobash and Dobash (2011) found that quite often if there has been possessiveness and jealousy in the relationship then these relationships are in danger of an intimate partner homicide occurring. Andy Chan and Jason Payne (2013) described other traits such as depression, mental health issues, fear of abandonment and impulsiveness may also be recognised when investigating an intimate partner homicide. Carlos Carcach and Marianne James (1998) found that 63 percent of intimate partner homicides between July 1989 and June 1996 where the male killed the female they were in a spousal relationship. Carlos Carcach and Marianne James (1998) also found that the data for intimate partner homicide has stayed stable over the year.
