The case between Homeless Hounds and Kimberly Stevens, Kimberly Stevens is suing for alleged fraud, false advertising, negligence and intentional infliction of emotion distress. Homeless Hounds is non-profit organization that takes dogs from different states and tries to find them loving homes. Before their arrival, the dogs are given vaccinations, spayed or neutered and tested for heartworm disease. Behavioral tests are occasionally performed, but are rarely documented. Kimberly one day while looking at the site feel in love with beagle named buddy, so she filled the online application for adoption. A state may request personal jurisdiction over an out-of state defendant considering the sufficient and minimum contacts the defendant has with the state in which the lawsuit is filed. Long-arm statues has been issued saying that “transacts any business or performs any character of work or service in the State” or “contracts to supply services or things in this state” is sufficient to have in personam jurisdiction. Since Homeless Hounds does in fact supply services and transacts a business with a resident from New Hampshire, it is noted that a court may exercise personal jurisdiction. The Long Arm Statue also states if “Causes tortious injury in the State or outside of the State by an act or omission outside the State if the person regularly does or solicits business, engages in any other persistent course of conduct in the State or derives substantial revenue from services, or things used or consumed in the State”. Since the injury of Kimberly son happened in New Hampshire, there is enough to also call in personam jurisdiction. Between these two factors, the link between Homeless Hounds and Kimberly Stevens is great enough to ensure in personam jurisdiction within the New Hampshire
