Hinkhouse was aware he was infected with Human Immunodeficiency Virus known as HIV, and was conscious of the consequences of having unprotected sex. Hinkhouse had several conversations with his parole officer Carroll towards his HIV disease and awareness of the harm it could cause if exposed to someone else. According to Hinkhouse case he “signed a probation agreement that included a commitment not to engage in any unsupervised contact with women without expressed permission from his parole officer”, (Hinkhouse qtd. in Jung 175) an agreement in which he failed to follow. The following year a social worker talked to Smallwood about safe sex to prevent the spread of HIV. According to Smallwood’s case in “July 1993, Smallwood told health care providers at Children’s Hospital that he had only one sexual partner and they always used condoms”;(Smallwood qtd. In Jung 175) however, he tested positive again for HIV in February and March of 1994. In September 26 1993, Smallwood and an accomplice robbed and rapped a women, on September 28 1993 robbed a second women to gunpoint and rapped her, lastly on September 30 1993 he robbed a third women at gunpoint and raped her. Smallwood did not use a condom when he raped these women exposing them to
