Mr Tuck

I am writing to you on behalf of my parents Anthony and Deborah Holmes to provide some furthur clarification on the circumstances regarding the debt owed to your client Mrs Harris. I understand its under your duress whether you take any heed of this email but I feel there has been some information lost along the line in regards to our agreement with Mrs Harris. I do not claim to have any legal knowledge on these matters so forgive me if the following is a bit basic but, as has been the case throughout, we aim to be fully transparent regarding these matters.
As you are aware Mrs Harris has a charge upon Anthony's interest in the property for £54,000. As you can see from the attached there are 2 prior charges in the same manner from

It was due to costs we never had this legally written up again, as at this point costs were mounting up fast (a mistake now I am dreadfully aware of). Mrs Holmes also agreed she would accept this arrangement and we would sort out our own finances once Mrs Harris and the other charges were cleared. We agreed to deal through Mrs Harries' contacts of AAA management. They have been through mortgage offers with myself and know this is a viable route, as far as I was aware we were simply waiting for the work to complete to obtain the completion certificate then would be in touch with them to set everything …show more content…
On starting the work One stop informed us that the work RJ home improvements had done had been substandard and needed re-doing ultimately meaning we had lost again 4 months of head way we thought we had gained. One stop produced excellent progression on the building works but once they had completed the contract we initially signed with them, they could not devote any more time to us due to other projects. The company we are working with now is Peter Schroders home improvements who are also producing excellent work and things are near finished. We are restricted by month by month wages to pay for the works and therefore is taking slightly longer than if there was some pot of money to draw on. £20,000 of my own finances later we are left with Only 3 points left to complete for me to obtain the mortgage. This was of course until we were knocked for six with the arrival of the letters from The Sheriffs Office company and proceeding forward looks

Rick Moore approached me to help him determine what kind of relationship our company, Stenbach Service Centre, has with Hannah, who provides property maintenance services to us. In order to define this relationship, I had to consider what the contract was originally intended for and what is actually involved. My first step was to go to the Canada Revenue Agency’s (CRA) website to find their guide titled Employee or Self-Employed? (http://www.cra-arc.gc.ca/E/pub/tg/rc4110/rc4110-e.html).…

In the present action, Ndeumeni’s motion for summary judgment was based on the premise that because the alleged agreement made between Ndeumeni and Kemogne failed to satisfy the statute of frauds, she should be precluded from arguing that there was an agreement under a theory sounding in tort. Initially, we observe that in her original complaint Kemogne did allege that Ndeumeni breached a contract with her. Plainly, a breach of contract claim could not be sustained where it is undisputed that the parties failed to comply with the statute of frauds with respect to their agreement to transfer real property.…

Given Derek’s sensitive situation, it is evident that there is a clear case of direct discrimination by association. In this circumstance, Derek has been passed for promotion due to his wife’s ill health covered under the same body of law as disability discrimination. Due to the perceived notion that Derek may be required to care for her leaving him less able to devote more energy to the role. The Equality Act 2010 introduced this part of discrimination by association into UK legislation, following the landmark decision of the European Court of Justice (ECJ) in Coleman v Attridge Law (2008). Given that confidential information had been used to cause a detriment to Derek’s application it could be argued, that a breach of contract under the…

The cases have contrasting outcomes due mainly due to the language used by Manchester City Council which ended in Storer being able to buy the council house and Gibson being declined to buy the council house. In the Case of Gibson, Manchester City Council stated that they “may be prepared to sell the house”; whilst in the Storer case they stated that “if you will sign the Agreement and return to me, I will send you the Agreement sign on behalf of the Council in exchange”. The language and conduct of the Manchester City Council was objectively scrutinized in each case and found that there was intention to be bound in the Storer case however there was no intention to be bound in the Gibson case, Poole (2012). This can be applied in the scenario here, the language must be objectively scrutinized as this may affect whether Gary was issuing a counter-offer or a mere request for further information. This is critical as a counter offer voids the original offer in its entirety and therefore it would be determined that there is no valid contract between Gary and…
