Hargroves Persuasive Essay

The Phillipses and Mikowski did not have the Higginses and the Hargroves removed from the Talbot Bank loans and to date, the Phillipses and Mikowski have not paid any funds to the Higginses and the Hargroves as required by the Purchase Agreements. In an effort to avoid their contractual obligations to the Higginses and the Hargroves, the Phillipses claim that the Higginses, the Hargroves, and the Fitzgeralds entered into a civil conspiracy to defame and disparage them, the Riverhouse, and Easton Golf. See Second Amended Counterclaim. The Phillipses contend this was done by spreading rumors throughout Talbot County, and by waging a “defamation campaign” on Facebook. However, at his deposition, Mr. Phillips only identified one individual that he contends told him that he heard derogatory or defamatory statements about him. Fitzgerald sent an email to the Hargroves; Mrs. Higgins; and Michael Rork and Tom Hanna, two former employees and minority shareholders of Riverhouse and Easton Golf; which stated, in part, “I say let the world decide. Facebook can be our jury. Maybe we should start a Facebook non profit page and call it The World [sic] Most Ridiculous Law Suit. Let the cards call where they may. Public opinion will rule. Thereafter, Mrs. Fitzgerald made numerous Facebook postings from late 2012 through approximately December 2013, concerning the Previous Litigation and Mr. Phillips.
