Handling of Legal/Ethical issue #1 Sustaining Life support disregard of the patient’s wishes The disregard of the patients’ rights as a health care provider, it is important to give the family time to accept their loss. “The treatment team allowed a week to pass to allow the husband more time to give him supported in his grief and to appreciate the gravity of his wife’s situation.”1 From the standpoint of a health care provider legally it is not possible to force the husband to abide by the wife’s wishes. “Ethics is not following the law.”3 Although being committed to creating and sustaining an environment that supports ethical practices and lawful behaviors is foremost in a situation like this simply disregard of the patient’s wishes and sustaining life support. Some emphasize that the ethical action is the one that provides the most good or does the least harm, or, to put it another way, produces the greatest balance of good over harm.3 Ethical responsibilities goes to the patient by preserving their dignity and respecting their wishes. Also, respecting the right of persons to make informed, uncoerece health care decisions or to have another person make those decisions on their behalf. The Greek philosophers have also contributed the notion that life in community is a good in itself and our actions should contribute to that life.3 As a health care provider and as an employer with a strong commitment toward patient care, the hospital and other network must cultivate…
