The Federal Communications Commission failed to follow the procedures dictated in the Administrative Procedure Act Code section 553c and 553b. Similarly, to the U.S. v. Nova Scotia the Food and Drug Administration (FDA) and the FCC failed to “give interested persons an opportunity to participate in the rule making through submission of written data, views, or arguments with or without opportunity for oral presentation” (APA Section 553c).
