Gnutella does not rely upon any centralized server or service – a peer just needs the IP address of one or a few participating peers to (in principle) reach any host on the Gnutella darknet. Second, Gnutella is not really “run” by anyone: it is an open protocol and anyone can write a Gnutella client application. Finally, Gnutella and its descendants go beyond sharing audio and have substantial non-infringing uses. This changes its legal

standing markedly and puts it in a similar category to email. That is, email has substantial non-infringing use, and so

Syllabus: A statute in the state Kansas make it a misdemeanor for any person participating in “debt adjusting”, with an exception to the practice of law. This statute does not violate the Fourteenth Amendment Due Process Clause since states have the power to enact what they consider injurious practices in commercial and business affairs. The statute is valid as long as the laws do not conflict with specific constitutional rulings and federal law. Procedural History: This case was filed by Skrupa doing business as “Credit Advisors” alleged that Skrupa engaged in “debt adjusting”. A three judge court heard evidence from Skrupa alleging the usefulness and desirability of the business as well as evidence by the state alleging that “debt advising” leads to grave abuses against distressed debtors, particularly in lower income brackets.…

Does the Sharing of Music Files Through the Internet Violate Copyright Laws? Michael Gibbons, October 6, 2015, Issue 6 Facts: The issue at hand is to determine if sharing music files through the internet violates copyright laws. It was found to be illegal to share music through the internet. In the case MGM Studios v. Grokster a unanimous decision was held that Grokster was to “be held liable for violating copyright laws by providing peer-to-peer file sharing software to the public,” (Katsh 98). VCRs were in question and used as an analogy by the Motion Picture Association of America (MPAA) in that “the VCR is to the motion picture industry and the American public what the Boston stranger is to the women alone,” (Katsh 99) in that the majority…

Blown to Bits Chapter 6: Balance Toppled Summary: Chapter 6 of Blown to Bits is a very interesting chapter. Chapter six dives into the often undefined world of copyright rights in computing. Copyright laws allow people to have full rights over their creative works and ideas, but this concept does not translate very well into the world of technology. Because information can be transferred with unparalleled ease in the computing age, intentional and unintentional copyright violations have become common.…

Within the past few years, music streaming sites like Pandora, Spotify, and iHeartRadio began to make their way into the digital world. One thing all these applications have in common is that they are free and convenient, a lot like file sharing. Some have argued that since the rise of these sites, piracy is beginning to become obsolete. In “Streaming Reaches Flood Stage: Does Spotify Stimulate or Depress Music Sales?”, the authors state how Spotify has changed the effect of illegal downloading altogether and that every forty-seven streams the file sharing rate goes down by one (Aguiar, Waldfogel, 2015). While this does help the artist in a way Spotify is stingy with how they pay the artist through the streaming service.…

Americans perceive downloading music as an everyday act, but it’s actually quite a criminal action. Consequently, downloading music allows the public to listen to their favorite artist for free or for a small price. Stephen Seigel elaborates by saying, “Under the agreement, Napster will begin to charge a monthly fee for use of it’s service--$4.95 seems to be the number being tossed around-- though how the money is ultimately divvied up will surely be a source of future contention.” (“Nipping at Napster”). This statement may convince the general public that downloading music is fine because the website is now charging a fee.…

Harper argued that the last statutory factor is undoubtedly the single most important component of fair use. The court reasoned that when fair use is properly applied, it is limited to copying by secondary users whose work does not substantially impair marketability of the original work. To refute fair use the court indicated that the original user would need to show that if the challenged use became widespread, it would adversely affect the potential market for the copyrighted work. The examination must take account the harm to the original aw well as the harm to the market for derivative works.…

Soon after debates of whether or not these industries were leading to decrease in music purchases began. Since this cite did not require payment of any kind, the company did not pay the artist how’s music was being shared.…
