Hodges case was a prominent one involving gay marriage. This court case was a 5-4 decision that debated whether or not same sex marriage is protected under the Due Process and Equal Protection Clauses of the Fourteenth Amendment. (ballotpedia.org) On another note, the court case Baehr v. Miike was the first ever case to rule that excluding same-sex couples from being married was considered discrimination. Clearly this was when certain individuals finally began to realize that this discrimination was an issue. This case was presented before Hawaii’s highest court, but in 1999 they ruled that their constitution did not protect lesbian and gay individual with regard to their freedom to marry.
