Gasoline is sold at retail in 300 different service stations in Hawaii. Chevron controlled 60 percent of the market for gasoline produced and 30 percent wholesale. The oil company brought a suit against Hawaii, challenging the statute limiting rent. Hawaii was concerned about the effects of market concentrations on retail gasoline prices. Hawaii passed Act 257, which limits the rent oil companies may charge dealers. Chevron which was one of the largest oil companies in Hawaii brought suit seeking a declaration that the rent cap effected an unconstitutional taking of its property and an injunction.
