that this is almost hardly getting covered. Women getting away with falsely accusing a man of raping her seems like it would be a much bigger issue than the false 1 in 5 women getting sexually assaulted. A woman named Nikki Yovino from New York accused two university football players of raping her in the basement at a party. But due to numerous accounts of witnesses saying she willingly went with the two into the basement, stating that she intended to have sex with them, she cracked. It was all an elaborate plan to win the affection of another boy. This case is extremely similar to the Rolling Stones case with “Jackie” thus this was named the “Jackie” syndrome, girls falsely blaming men of raping them to get the attention of someone else. The subject of the case is "A rape on Campus", an article written by Sabrina Rubin Erdely in Rolling Stones magazine. Erdely is a writer, journalist and editor at Rolling Stones. The article lacked integrity and substantial evidence as the victim wasn't questioned. I'm writing about this case because it demonstrates how a journalist's writing can be falsified if not backed up with proof. Also, it's ironic that the story managed to slipped by the professionals, get published, and read almost three million times before being doubted.…

Rape law also “[assumes] that women lie about their nonconsent to sexual activity for various reasons” (Levit and Verchick, 3911), thus giving the accused much more power than the accuser. This considerable power imbalance further complicates an already-sensitive area of law, and stands in stark contrast to other standing laws, like sexual harassment-related holdings, which instead favor the accusers over the accused (Berk lecture, 10/24). Why have these contradictory methodologies? Why place undue suspicion on people who are most likely hurting and…

Rape and sexual assault are relevant topics in today’s society. One in six women in the United States “has been the victim of an attempted or completed rape in her lifetime” (“Effects”). The perpetrators are often not prosecuted or expected to take responsibility for their actions. For example, in the rape case “Turner vs. the People,” Stanford Swimmer, Brock Turner, was accused and found guilty of three felony counts of sexual assault and only spent three months in jail, far less than the maximum fourteen years that he could have faced (Stack). Even though he raped an unconscious woman, Brock Turner was only sentenced to six months because, according to the judge: “A prison sentence would have a severe impact on him” (Stack).…

There are numerous cases of sexual assaults that the victims are blamed for of prosecuting the criminal. Suggesting or directly insinuating that the victim ought not to dress a certain way or act a certain way. The fear of being crucified prevents some victims from speaking or reaching out for the help they need. Some simply commit suicide or live in misery. These are extreme cases, but very valid examples.…

Spohn (2001) and Kane (2005) had both focused on decision making of criminal justice actors. Spohn (2001) focused on using individual-level data with qualitative method driven data and Kane (2005) used a macro-level approach using quantitative data methods. These two different methods brought out important but different perspectives into criminology research. Kane use a macro level approach to looking at police legitimacy and predicting violent crime.…

Sex crimes should be properly reported, investigated, accounted for, and properly handled in all police departments. A prevalent issues within a number of police departments all over the nation is the undercounting of reported rapes. Several departments have been known to substantially undercount rapes that were reported by victims creating “paper” reductions in crime. Some law enforcement need to trust victims more, make sure they are safe after reporting their incident, and provide all the resources that are available to assist victims during their times of distress. Perhaps training on sex crimes and how they should be properly handled should be implemented and required for all officers and all police departments to…

Various studies have been conducted with the aim of discovering and understanding why sexual assaults and rapes remain underreported. While these research projects have been performed across vast and varied cross-sections of the American population, not to mention smaller, focused studies, results still show that the majority of crimes involving rape, attempted rape, or other forms of sexual offenses are not recorded by local police agencies. The data for these previous projects were drawn mostly from the National Crime Victimization Survey (NCVS) and the National Incident Based Reporting System (NIBRS) by Ronet Bachman, submitted in 1998, along with Karen Weiss’ more recent (2011) submittal on the same subject. Taking the drawbacks of NIBRS and the NCVS into consideration, these authors managed to expose tendencies that provide insight into the realm of sexual crimes. But the question as to why rapes and similar crimes remain underreported may lie in the attitudes of victims.…

This explains why sexual assault is widely considered to be the most underreported violent crime in the United States. Survivors have stated some of the reasons they did not report their sexual assaults. The survivors said they were in fear of reprisal, they did not think their case was important enough to respond to, they had a belief that the police would not do anything to help, they did not want family or others to know, they feared there was a lack of evidence and many more reasons. Due partially to low reporting rates, only 9 percent of all rapists get prosecuted. Only 5 percent of cases lead to a felony conviction.…

Sexual assault is an epidemic that has reached significant proportion as newer generations become increasingly aware of its presence. As the public becomes more knowledgeable about rape and assault, they also become mindful that individuals, such as the Brock Turner case, were able to defend their case effectively leading to a shorter sentence and less punishment. In recent decades, the eminence of power and status creates a faulty line for those who have committed previous attacks; celebrities and other famous individuals seem to easily overcome the obstacles of accusation in court. The popular press article “In Kobe Bryant Case, Issues of Power, Not of Race” by Kirk Johnson (2004), exemplified the fact that in the case of Kobe Bryant, it…

All types of rape lead to the same outcome, which the victims fear in something if not everything. Clearly what angers the rape lobby (and the rest of us) is that a lot of men get away with rape, either because women can’t or don’t report it, or because the courts can’t or don’t prove it. It is also true…
