In Subsections (3), (5), and (6), they discuss specific provisions under which the state treasurer may decree that the local unit of government must additionally cover insurance gaps and fully protect individuals acting under PA 436 on their behalf. Additionally, the state is permitted to withhold amounts owed out of the revenue sharing due to the local government. Furthermore, there are certain types of lawsuits that would fall under the state attorney general’s jurisdiction—meaning the attorney general would defend the emergency manager and their employee(s) and bill the local government or the City of Flint for his services. While there is an obvious corruption scandal that has been unfolding before our very eyes as even criminal charges may be brought up, the origin of this scandal seems to originate in the very policy that oversees financial emergency management in the state of Michigan. There are calls for this law to be repealed as well in a referendum move. An initiative in rewriting this law, or coming up with a new law altogether, or amending the state constitution is always another option in the form of a constitutional amendment initiative petition. Such drastic measures made against the Emergency Manager law, may be necessary, as it gives more power to the state officials than they need to have and insulates them from liability and indemnifies their positions of power. Counter arguments against changing this law and its need for existing will also be examined.
