Fereshta Mirvace Case Study

Fereshta, Mirvace’s widow, was born in 1365 (1986). She only speaks Dari and she is illiterate. She has no formal education, whether academic or religious, and she has never worked outside the home. She lives in Kabul and has never left Afghanistan. She does not plan to attend the trial in the United States.

The witness testified that the purpose of her deposition “is to protect her husband’s rights” and the lawsuit seeks compensation for his loss. She does not have an attorney in Afghanistan, but “Miss Anna” is her attorney in the United States. Fereshta did give documents to her attorneys, but she does not know what they were because she cannot read. Her father is the person with the most knowledge of the case.

She did not receive Mirvace’s remains until forty days after the occurrence and her family took care of organizing the funeral and mourning activities. She does not know the amount of the costs related to those activities, but she does not believe that they borrowed money to cover the expense.

Throughout their marriage, Fereshta and Mirvace lived in his house in Kabul with his mother, Khanom Gol. Mirvace was healthy and she believes that Mirvace was approximately thirty-one when he died. She is not aware of his ever seeking counseling. Mirvace did serve in the military, but she had no information regarding his education. Mirvace’s father had passed away, but Fereshta did not know when or how.

For approximately three months before the accident, Mirvace had been working as a generator operator for MTN (a communications company) and as a cook for Sanpo International (a construction project management company) in Kunduz. (The damages documents contain only information regarding Mirvace’s employment with Sanpo.) He was a carpenter in Forney before working at MTN and Sanpo.
