Committing murder under the circumstances of fear is never justified. The facts to prove this reasoning are that fear is emotion of the human race. The episode of Doctor who "midnight" is a great example of killing in the instincts through fear. The character on the futuristic train were in fear of their life, as an alien type spirit takes over sky's body, sky is one of the characters on the train. The individuals all agreed, besides the doctor, to throw sky off the train into the deadly atmosphere. Murder under the terms of fear would most definitely be unjustified do to the facts that everyone gets scared.
