Her new boyfriend is abusive to her and her two children but she denies it anyways. Now the children are in more danger than ever before base on her reason of denying that he abuses her. Some of the reasons she denies him abusing her could be he is either threatening to harm her or the children if she should alert authorities.
Based on the constant reports of child neglect/abuse that child’s welfare have received from Marcia’s home, the constant substance abuse and physical abuse in front of the children, that’s enough reason to remove the kids from such an environment before the situation worsen.
Both parents needs to agree to seek help from drug addiction counseling center or a rehab facility voluntarily immediately to reinstate the children. The court cannot make them seek treatment involuntarily, because if they do, the parents would not admit to their addiction and be able to fully open up and accept change. However, the court can make it clear to them that seeking addiction help is the first step to them getting their children back. Meanwhile, the children can be place in a temporary care of a reliable family member. Marcia’s boyfriend cannot be in the picture base on his addiction issues or abuse towards her and her kids and possibly threats that could make Marcia denies him abusing her after stating that Charles used to abuse her. While both parents are receiving addiction treatment, a well conducted investigation can procced, checking for any form of other endangerment to the children or proof of whether they would be capable to care for the boys again. Also, no alcohol beverages, drugs or other forms of harm can be surrounding both parents living environment, any clues that could possible lead them back into their old habits.
Secondly, a random drug test can be carry on them by the court following a written agreement that both Marcia and Charles agree to do so in order to be given temporary custody were they would have visit supervision three times a week by a social worker to ensure the safety of the children. With such supervised visits for over good three months and if the parents stay sober during those length of time, then that is a good start to a safer environment for the
