As noted earlier the defendants claimed that the order was carried out with the goal of training Santiago not to kill him. Therefore the defendants did not have malice intent. Going on the criminal act of manslaughter is the conduct that causes the victim’s death. As a result of the rag being forced in to the victim’s mouth, he died. Thus but for these actions again this was the direct legal cause of the harm. Equally, under these circumstances there was an extremely reckless disregard for the value of human life. A reasonable person would have known that using a gagging device on another person will tapping their mouth shut could possibly result in the death of that
