Upon arrival, Officer Jimenez observed three males arguing near the leasing office. Officer Jimenez observed that one of the males, later identified, as Frederick Dean (B/M-DOB09/18/1983) was acting belligerent towards the other two males on scene. Officer Jimenez made contact with Dean.
Upon contact, Officer Jimenez noticed Dean had a strong odor of alcoholic beverages coming out of his breath. Officer Jimenez observed that Dean had bloodshot eyes. Officer Jimenez also observed Dean had slurred speech. Officer Jimenez asked Dean a series of questions in order to conduct his investigation in reference to the disturbance. Due to the disturbance that just took place and Dean acting belligerent Officer Jimenez placed Dean in handcuffs. Officers at the scene had to give Dean strong verbal commands because he kept interrupting Officers.

During the search, Officers were able to locate in Dean’s left pocket a “Phd Beta Alanine” workout supplement bag with several pills inside that based on Officers training and experience appeared to be Xanax. Officer Jimenez observed that the prescription medication was not in the prescribed bottle. Dean was also unable to produce a prescription of the Xanax found in his possession at the time of the contact. Dean was within reach of the Xanax found in his possession therefore he was in care, custody, control and management of the prescribed medication. Officer Jimenez charged Dean with Possession of a Dangerous
