In Nicholas v. State, the officer testified “that the car was in neutral at all times” Nicholas v. State, 783 N.E.2d 1210. Nicholas was found to not be operating the car. Though he had applied the brake, the car was in neutral, so he applied it to stop, not operate, the car. Hiegel v. State precedent this when the court ruled that though Hiegel had started his engine and his auxiliary functions were on, his car was in park, and he hadn’t operated the car. In Shaw v.
