Abortion is the deliberate termination of a fetus, usually within the first few months of pregnancy. The subject of abortion is a widely debated topic and generally people are separated into one of two groups depending on their opinion, into either pro-life or pro-choice. People who believe that abortion is ethically and morally wrong for whatever reason are considered to be part of the pro-life group. However if you believe that abortion should be available to women, and that women have the right to choose then you would identify with the pro-choice group. These human rights are supposed to be guaranteed by the government and considered a basic necessity for life, the UN’s Universal Declaration of Rights and Freedoms is an international document signed by almost all of the countries in the world. As well as the Universal Declaration of Rights and Freedoms, most countries have a charter of rights and freedoms specific to their country and are protected by law. This theory states that you have all the rights and freedoms available to you as long as you do not transgress someone else’s rights, for example I have the right to own property, but I can’t steal my neighbor’s house because that would be infringing his right to property. This leads to why the abortion law was abolished in Canada in 1988 in the court case Morgentaler vs. Her Majesty the Queen, it was found during this case that the abortion law in Canada transgressed two primal rights of women; a women’s right to liberty and a women’s right to security of person. A women’s right to liberty dictates that women are to be in charge of major decisions in their life, including their reproductive health and a women’s right to security of person dictates that it’s wrong to force a women to carry an unwanted fetus to full term under criminally sanctioned threats. This means that across the world where abortions are not available to women their very rights are being transgressed by the government, because the government believes in the moral personhood of the fetus as having rights from the time of conception rather than when it is a viable
