What these people do not realize is that most states limit judicial waivers- which gives the court the right to transfer a case to criminal court (Juvenile Justice Reform Initiative, 2014)- to youth who are considered to be “no longer amenable to treatment” (PBS Frontline, 2014). One of the large differences between Juvenile and Criminal court is the emphasis on rehabilitation, juvenile court wants to put children back on the correct path while criminal court wants to punish for wrong doings (National Report Series, 1999). Many states even have criteria that determine whether or not a case will be sent to criminal court or stay in juvenile court, completely removing the choice from judge (PBS Frontline, 2014).
